Guiding Terms and Conditions

The purpose of the present General Terms and Conditions of Supervision is to set out the terms and conditions of the Supervision / Coaching / Guiding / MTB Training service provided by SARL N.K.Bike, hereinafter referred to as “the School”, and to govern relations with the customer, hereinafter referred to as “the Customer”, for orders placed on the www.bikeexperience.fr website, by e-mail, by telephone, in the store at 99 rue de la poste 74440 Taninges or in our partner stores, and to define the respective rights and obligations of the parties.

The customer declares that he/she has read and accepted the General Terms and Conditions of Sale prior to booking. Booking by e-mail, telephone, via the bikeexperience.fr website and the online booking module therefore implies acceptance of the General Terms and Conditions of Sale.

N.K.Bike reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Site.

The school’s instructors are all state-qualified, unionized Moniteur Cycliste Français members, and hold valid authorizations to teach mountain biking and all other cycling disciplines. They are also covered by professional liability insurance.

It is the customer’s responsibility to take out the insurance of their choice to cover the risks inherent in mountain sports (civil liability, rescue). Customers are solely responsible for their own equipment. The School’s instructors cannot be held responsible for any damage caused by this equipment, or in the event of theft or damage.

The School holds an Allianz Actif Pro contract No. 62524828 for Operating Liability and Professional Liability for the activity of Guide / Instructor.

The School accepts no liability for damage to transported equipment (bicycles). It is the responsibility of the owner to check that the bicycle is properly installed on the transport trailer during services requiring transport.

 

The services offered by the School are described and presented as accurately as possible. The School and the instructors cannot be held responsible for any slight variation between the services offered and the presentation made on the site, by e-mail, by message or by telephone.

By booking, the Customer confirms that he/she has the required level for the chosen service. He/she undertakes to listen to the instructor’s advice to ensure his/her own safety and that of the group.

Reservations are made online via the YoPlanning system, accompanied by payment in full for the service, via the Payline system, by bank transfer, in cash or by credit card directly in the store. Placing an order implies acceptance of the General Terms and Conditions. Services are reserved for firm dates, or in the form of gift vouchers.

The customer may cancel a reservation under the following conditions:

  • more than 7 days before the event: cancellation without reason and full refund.
  • 7 days to 72 hours before the event: the School retains 30% of the total amount as compensation.
  • less than 72 hours before the event: the full amount is due, in accordance with the price list in force on the day of booking. Cancellation fees will not be retained if the cancellation is caused by the customer’s illness or accident, duly justified on presentation of a medical certificate.

In the event of the customer’s absence at the start of the course, or during the course, for whatever reason, the price of the course will not be reimbursed, and the course will not be exchanged for another. Weather conditions do not constitute a cause for cancellation of a service provided by the School.

The School reserves the right to cancel or interrupt lessons in the event of force majeure, such as the closure of ski slopes or ski lifts, or in the event of very bad weather. In this case, The School will propose an alternative date for the lesson or refund the full amount previously paid to The School.

The School’s instructors reserve the right to exclude at any time any person whose behavior is such as to disturb the smooth running of the course. Cancellation, interruption or exclusion do not give rise to any compensation or reimbursement. Any course started is due in full.

The school prices can be found on the website www.bikeexperience.fr and are displayed in the store at 99 rue de la poste 74440 Taninges or in partner stores.

The prices shown include the services of a School instructor, transport according to the chosen service, and exclude all other services (insurance, accommodation).

To use the ski lifts, customers must have a valid lift pass (except in the case of a 4-day or 4-half-day course, when the lift pass is provided).

Rental of bikes and protective equipment is not included in the price. However, it is possible to rent this equipment in the store at 99 rue de la poste 74440 Taninges or in our partner stores.

In the absence of written notification to the contrary sent to The School before or at the latest on the day of the service, the customer’s acceptance of the General Terms and Conditions of Sale constitutes authorization for the reproduction and representation of photographs and videos in the event of reporting.

Consequently, the Customer authorizes The School to distribute images taken during the activity. The images may be used directly and without any time limit (press, brochures, posters, internet, etc.) to promote the School’s activities.

The Customer acknowledges that he/she is fully entitled to his/her rights and may not claim any remuneration for the use of the rights referred to in the present paragraph.

The information collected is subject to data processing for the exclusive use of N.K.Bike, whose head office is located in Taninges.

In accordance with the General Data Protection Regulation (GDPR) adopted by the European Parliament on April 14, 2016, and the French Data Protection Act of January 6, 1978 relating to data processing, files and freedoms, any person has the right to access and rectify information concerning him or her, by contacting N.K.Bike. Customers may also, for legitimate reasons, object to the processing of data concerning them.

The parties will endeavor to resolve any difficulties that may arise in the performance of the contract amicably. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and performance of the present agreement will be governed exclusively by the rules of French law and dealt with by the Bonneville court. All disputes of any nature whatsoever shall be subject to the jurisdiction of the French civil and commercial courts, including summary proceedings.
